Terms and Conditions

Arranging the Funeral

The Company will not be responsible for deciding who has the legal right to arrange a funeral, this will be the person who is usually the next of kin or someone who has designated responsibility such as an executor of the estate or upon instruction of someone acting in the absence of an executor or family member. This person will be the client and all information will only be relayed to the “Client”.  Any reference made to “Company” within the Terms and Conditions will always be referring to Falconer Funeral’s Ltd

 

Estimation and Expenses

The Company estimate given will detail the services we have agreed to offer to you, this estimate will be based on information taken from you on the initial date of meeting. The Company will do its best to ensure the estimate given is accurate, all charges will be liable to change especially if third parties are involved and changes of their rates increase, this will be out of our jurisdiction.

 

VAT will be added to our charges at the current rate where applicable when we put together your estimate and final account.

 

Funeral Timings

The timings and dates given at the 1st meeting will not be guaranteed until confirmation from all third parties have been received, in some instances although confirmation has been given, minor changes to timings and arrangements may have to be change due to unforeseen circumstances beyond our control.

If this is going to happen the client will be notified in advance, although not always possible.

 

In some instances, delays may occur because of traffic, adverse weather, road works, or mechanical failure, some of the vehicles used are Victorian, classic, or vintage so mechanical failure can occur, in this situation the Company’s charges remain payable in full as we cannot accept liability for this.

 

Data Protection

As a Company although we cannot register under the Data Protection Act 1998 it will always respect the confidential nature of the information given. The Company will ensure that all information will be sure is kept secure and in confidence and is only administered for the purpose of carrying out the required service. Data, however, will need to be passed to third parties who have been requested to perform services for clients and they may contact those clients directly. If a client would like to receive copies of the data, they can put this in writing to the Company on payment of a fee. Clients should also note that information about the timing and details of the death and the funeral ceremony will be deemed to be in the public domain, therefore any enquiries requesting information about the death and the funeral will be replied too.


Third Party

The responsibility of the Company will only be for the funeral arrangements which it will perform, all arrangements made with third parties will be made as necessary on behalf of Client (such as with Ministers, churches, Cemeteries, Crematorium, Organists, Gravediggers, and all other relevant parties) this is done as a declared agent. Accordingly, the third parties involved (and not the Company) are responsible to the client for the provision of those services. The Company is charged for their services by third parties and will then charge its client for these services and will identify those as disbursements on the invoice. Some third-party suppliers offer to invoice the client directly for their services rather than invoicing the Company if this is an option the Company will always select this on behalf of the client. No liability for any errors made by third party companies or service providers, such as wrong grave sizes, location of grave opening for cremated remains burials or damages to headstones caused by the need for removal for a burial to take place will be accepted by the Company, an agreement is signed which will give full permission to remove any headstones and or subsequent grave fittings for a burial to take place.

 

Payment Arrangements

An invoice for payment will be issued in relation of our services provided and for any other work undertaken, payment will need to be paid within the terms stated. The client is responsible for making all payment in respect of all the Company’s charges and disbursements, the client is also liable to the Company until payment of the invoice is paid in full. If the invoice is forwarded to any other persons, it will still be the client’s responsibility, it will not discharge the liability.

 

If a claim for DWP funding is made and there is a shortfall the remaining balance is still the responsibility of the client, the Company will not be responsible for the difference between the actual and anticipated grant

 

Terms of Payment

Payment in full will be required no later than a week before the funeral taking place, if the Company does not receive payment within the time scale given it reserves the right to postpone the funeral or alternatively withdraw our services.  On occasions if a family add anything to the arrangements such as an extra limousine or flowers after the invoice has been given will subsequently have an outstanding balance and a bill will be sent out 2 days after the funeral has taken place with a request for the balance to be settled once in receipt. The Company's final account may vary from the estimate as it will include the charges for any additional goods and services consequently ordered and any third-party values will be actual gross amounts rather than an estimate. If an account is not settled within the time frame given an interest rate on the outstanding balance at the rate of 5% above Tide base rate. In some instances, legal and administration fees may apply if the account is not settled as the Company will not endure any cost because of a breach of contract.

 

Rights to Cancel

The Consumer Contract Regulations 2013 gives a client signing a contract with a company in their home the right to cancel within 14 days of that period, day one being the date the client signs and the agreement is acknowledged. If a client wishes to cancel the contract a cancellation notice needs to be sent within the 14 day period of cancellation to the Company. If you cancel our services during the cooling off period, if any goods or service from us during this period has been received payment of this will have to be paid for incurred costs and expenses as the Company will need to be reimbursed.
 

Hygienic Treatment

The Company transfers the deceased to its premises in the clothing worn unless advised different. Any soiled clothing will be removed for the prevention of health and safety as waste. Hygienic treatment will be given to all deceased taken into our care which may include embalming required for the health and safety of our employees or viewing purposes an agreement will need to be signed which permits us to embalm your loved one. Any valuables left with the deceased at the time of collection are done so without the company bearing any responsibility for these items. It will be the client's responsibility to inform us if you wish for these items to be returned to you or be left on the deceased if jewellery or other valuables are placed in the coffin with the deceased during viewing visitations the company will not be responsible for its protection and will not consent to liability in the event of loss or damage. No responsibility if these items are subsequently not removed and are either buried or cremated at the time of the committal therefore any jewellery should be collected before the funeral.

 

Donations

To facilitate the collection of monies in aid of charitable organisations in lieu of flowers the company shall create a memorial page on its website, this page contains a donation facility enabling mourners to make online payments directly to the charity in memory of the deceased. following the funeral, any money collected at the service will be added to this page by the company. In signing this contract, you agree to the company creating and publishing a memorial page on its website and acknowledge and agree that the published page will contain details of the deceased, such as full name, date of birth and death, age, funeral location, date, and time. You also acknowledge and agree you will be listed as the owner of the page. Without your permission company will not be unable to collect any memorial donations before, during or after the funeral.
